Dear Friends: At this writing there is a grieving father in Florida in prison for twenty years for leaving his baby daughter in the back of the family car. A tragic mistake too often repeated, yes, but none- the- less a mistake. California, humanely, did not send its grieving father, a college professor, to prison nor even impose probation. But in Fort Lauderdale, Florida, in the heat of the moment, Antonio Balta, an uneducated immigrant, was handed the stiffest sentence of any father in America. Now is the time to free him. Jonathan Turley, the famous Public Interest Law Professor at George Washington University seems to grasp the problems of our present-day legal system better than anybody. He points out that there are 714 incarcerated Americans per 100 thousand, (as of two years ago) the highest rate in the world. He characterizes our system as "Gulag America". "While acknowledging that many cases shock the conscience, few should be treated as crimes". "Sometimes justice requires an element of restraint in expressing it's anger over the behavior of a parent". "Criminal prosecution becomes a form of social judgement a way to express social outrage, I think the best prosecutors resist the temptation to use prosecution as a form of social condemnation". "The core of criminal law is that acts are done with intent. Negligence has been confined to the civil docket" "Allowing prosecutors to pursue acts of negligence radically increases their power and their ability to abuse it". What these profound observations prove is that power is pretty heady wine, and that if not tempered with mercy can reflect badly on our judiciary and become an assault on our collective good conscience. Antonio Balta stands as the poster boy for an over-long prison sentence that needs revision. We must free Antonio Balta now. |
