Here is a chance to correct an injustice...

...and, incidentally, save the state of Florida
$300,000 to $400,000...

ANTONIO BALTA IS NOT A CRIMINAL...

Antonio Balta is...

• A father, grieving over the accidental death of his child in a hot car...

and he is...

• The only father in America given a 20-year prison sentence, when others who make similar fatal mistakes are not charged, or get probation...

The question must be asked, what is the point of keeping him in prison any longer?

and he has...

• Already served over 6 years in prison, and is a model prisoner...

and it's time he should be freed...

• Now, under Florida’s Law HB667, passed in 2007, the maximum sentence is 5 years. Representative Joe Gibbons was inspired by Balta's tragedy to craft his legislation, but so far it has not been applied retroactively in his case.

Golden Opportunity:
Florida’s Inspirational Governor Charly Crist, is aware of the interest of State Representative Joe Gibbons as well as many other deeply concerned Floridians and national supporters of judicial fairness across America.

Governor Crist may be in the enviable position of being able to pardon Antonio Balta before he leaves the Governor’s office in November.

The governor’s insightful pardon can provide trend-setting momentum and needed revision to our nation’s runaway penal policies.

Dear Friends:
You and I are needed to rescue ourselves and our planet from selfishness and indifference. In the name of plain decency and simple fairness we can take a stand..

At this writing there is a grieving father in Florida in prison for twenty years for leaving his baby daughter in the back of the family car. A tragic mistake too often repeated, yes, but none- the- less a mistake. California, humanely, did not send its grieving father, a college professor, to prison nor even impose probation. But in Fort Lauderdale, Florida, in the heat of the moment, Antonio Balta, an uneducated immigrant, was handed the stiffest sentence of any father in America. Now is the time to free him.

Jonathan Turley, the famous Public Interest Law Professor at George Washington University seems to grasp the problems of our present-day legal system better than anybody.  He points out that there are 714 incarcerated Americans per 100 thousand, (as of two years ago) the highest rate in the world. He characterizes our system as "Gulag America".
And says:

"We must decriminalize negligence--criminal charges are only for true crimes and true criminals".

"While acknowledging that many cases shock the conscience, few should be treated as crimes".

"Sometimes justice requires an element of restraint in expressing it's anger over the behavior of a parent".

"Criminal prosecution becomes a form of social judgement a way to express social outrage, I think the best prosecutors resist the temptation to use prosecution as a form of social condemnation".

"The core of criminal law is that acts are done with intent. Negligence has been confined to the civil docket"

"Allowing prosecutors to pursue acts of negligence radically increases their power and their ability to abuse it".

What these profound observations prove is that power is pretty heady wine, and that if not tempered with mercy can reflect badly on our judiciary and become an assault on our collective good conscience.

Antonio Balta stands as the poster boy for an over-long prison sentence that needs revision. We must free Antonio Balta now.
